In Montgomery County All Fireworks Are Illegal

Fireworks: Questions you may have about fireworks.

* What fireworks are legal?

In Montgomery County, all fireworks are illegal to possess or discharge including gold label sparklers.

Snap-and-pop noise makers, snakes, and party poppers are the only exception to this law.

* Can I receive fireworks at my home through the mail?

No. Use of the mail for the transportation of fireworks for use in the State of Maryland is illegal.

* Can I have a private fireworks display at my residence with proper permits?

No. You can’t have a private display; however, you can have a public display with proper permits and insurance.

*Can I receive fireworks at my residence delivered by public carrier?

No. It doesn't matter where the fireworks are purchased or how they are brought into Maryland. Fireworks are still illegal.

Couple of weeks ago I saw Costco was selling some fireworks. I clearly remember seeing sparklers. In fact I did check at the counter to make sure they are legal. Any comments re whether they are ok to use or not? If they are illegal then they should not be allowed to sell in these stores.

We actually visted the COSTCO you mentioned as someone else also expressed concern. After reviewing it was found that they
are selling the approved "poppers", "snakes", etc. So they are good to go.

What about fountains? They sit on the ground and are pretty innocent.

I live on Gretchen Street, Kensington and have been listening to fireworks going off for over 30 minutes with loud cheers from whomever is at the gathering.

If that happens again, please give us or Mont Co Police a call. We need to catch them in the act but we can only be at so many places at one time. Please do call and give us a heads up.

We had a similar situation occur either ON July 4th or July 5th where our neighbors were setting off fountains during a party. They set them off pretty close to their fense as well. i video taped it from the street. the weather that day (as i remember correctly)was pretty hot and on the dry side. another neighbor sets off some bigger ones right under trees, but he waits long periods of time before setting off other ones. would this qualify a call to MCPD? (even if the fireworks aren't being set off at the time of the call to MCPD)

I had a question though. Should someone still report a person who has been setting off fireworks even after the person has stopped firing them off? because i have a neighbor who will set off some big fireworks, but will wait about 7 minutes before setting off the next. (i am guessing so that he doesn't draw attention). should someone still report in this situation? he also has trees right above his launch site.

Some of my fondest memories as a kid involved gathering at the old Safeway parking lot and setting off fireworks with our neighbors. This was in CA and it was legal. Such a shame the freedoms we once enjoyed are being stripped away from us one by one without so much as a vote. Surely the people of this county are capable of acting responsibly. In HI they issue individual permits that puts responsibility in writing. This is better. A complete ban is unamerican.

This is another obscene and inappropriate "law" which infringes on citizens' rights. My goodness, what's next? Banning bags - been there done that. Rain tax - been there done that. Trans-fat - been there done that. Liberal statism run amok.
